The most influential theory of law in current analytic legal philosophy is legal positivism, which generally understands law to be a kind of institution. The most influential theory of institutions in current analytic social philosophy is that of John Searle. One would hope that the two theories are compatible, and in many ways they certainly are. But one incompatibility that still needs ironing out involves the relation of the social rule that undergirds the validity of any legal system (H.L.A. (...) Hart's rule of recognition) to Searle's notion of codification: the idea that institutions need official declarations of their constitutive rules in order to enjoy the full benefits of institutions. The incompatibility arises from the fact that, in order to do its institutional work, the basic validity rule must be codified in Searle's sense—yet, given the particular role it has in legal positivism, it may be impossible to codify in the Searlean sense. In this paper I develop the incompatibility in detail, consider and reject consigning the basic validity rule to Searle's “Background” capacities that support institutional facts, and conclude that the best route to eliminating it while doing a minimum of damage to the two theories is to make a slight emendation to Searle's theory of institutions. Background: The factors influencing parents’ willingness to enroll their children in biobanks are poorly understood. This study sought to assess parents’ willingness to enroll their children, and their perceived benefits, concerns, and information needs under different consent and data-sharing scenarios, and to identify factors associated with willingness. Methods: This large, experimental survey of patients at the 11 eMERGE Network sites used a disproportionate stratified sampling scheme to enrich the sample with historically underrepresented groups. Participants were randomized to receive one of (...) three consent and data-sharing scenarios. Results: In total, 90,000 surveys were mailed and 13,000 individuals responded (15.8% response rate). 5737 respondents were parents of minor children. Overall, 55% (95% confidence interval 50–59%) of parents were willing to enroll their youngest minor child in a hypothetical biobank; willingness did not differ between consent and data-sharing scenarios. Lower educational attainment, higher religiosity, lower trust, worries about privacy, and attitudes about benefits, concerns, and information needs were independently associated with less willingness to allow their child to participate. Of parents who were willing to participate themselves, 25% were not willing to allow their child to participate. Being willing to participate but not willing to allow one’s child to participate was independently associated with multiple factors, including race, lower educational attainment, lower annual household income, public health care insurance, and higher religiosity. Conclusions: Fifty-five percent of parents were willing to allow their youngest minor child to participate in a hypothetical biobank. Building trust, protecting privacy, and addressing attitudes may increase enrollment and diversity in pediatric biobanks. (shrink)

The ontology of ‘powerful qualities’ is gaining an increasing amount of attention in the literature on properties. This is the view that the so-called categorical or qualitative properties are identical with ‘dispositional’ properties. The position is associated with C.B. Martin, John Heil, Galen Strawson and Jonathan Jacobs. Robert Schroer ( 2012 ) has recently mounted a number of criticisms against the powerful qualities view as conceived by these main adherents, and has also advanced his own (radically different) version of (...) the view. In this paper I have three main aims: firstly, I shall defend the ontology from his critique, arguing that his criticisms do not damage the position. Secondly, I shall argue that Schroer’s own version of the view is untenable. Thirdly, the paper shall serve to clear up some conceptual confusions that often bedevil the powerful qualities view. While functioning quite well for many years, the bioethics profession is in crisis. John H. Evans closely examines the history of the bioethics profession, and based on the sociological reasons the profession evolved as it did, proposes a radical solution to the crisis.

Kant’s philosophy of science takes on sharp contour in terms of his interaction with the practicing life scientists of his day, particularly Johann Blumenbach and the latter’s student, Christoph Girtanner, who in 1796 attempted to synthesize the ideas of Kant and Blumenbach. Indeed, Kant’s engagement with the life sciences played a far more substantial role in his transcendental philosophy than has been recognized hitherto. The theory of epigenesis, especially in light of Kant’s famous analogy in the first Critique, posed crucial (...) questions regarding the ‘looseness of fit’ between the constitutive and the regulative in Kant’s theory of empirical law. A detailed examination of Kant’s struggle with epigenesis between 1784 and 1790 demonstrates his grave reservations about its hylozoist implications, leading to his even stronger insistence on the discrimination of constitutive from regulative uses of reason. The continuing relevance of these issues for Kant’s philosophy of science is clear from the work of Buchdahl and its contemporary reception. (shrink)

Few outstanding questions in the human behavioral sciences are timelier or more urgently debated than the evolutionary source of religious behaviors and beliefs. Byproduct theorists locate the origins of religion in evolved cognitive defaults and transmission biases. Others have argued that cultural evolutionary processes integrated non-adaptive cognitive byproducts into coherent networks of supernatural beliefs and ritual that encouraged in-group cooperativeness, while adaptationist models assert that the cognitive and behavioral foundations of religion have been selected for at more basic levels. Here, (...) we survey these differing approaches, noting their respective strengths and weaknesses. We then advance a novel model that centers on the ability of language to generate alternative worlds independent of immediate empirical facts, and thus highlight the similarities between religious belief and the modes of cognition that underlie institutions in general. The institutional cognition model of religion accounts for some of the shortcomings of extant approaches and draws attention to the human ability to create non-empirical worlds; that is, worlds that are imaginary. Both religious beliefs and institutional facts—such as jurisdictional borders—are non-empirical assertions, yet they are socially accepted as truths and reified through ritual and behavior. One type of non-empirical, linguistically generated belief—supernatural agent belief—is particularly effective for stabilizing systems of arbitrary norms by rooting them in deontic rather than utilitarian reasoning. The evolutionary roots and continued persistence of religion are thus functions of the capacity for humans to generate cognitive alternatives to empirical reality, and the need to stably coordinate those alternative conceptions. These two articles examine whether Sartre's final interviews, recorded in L'Espoir maintenant ( Hope Now ) indicate a final turn to God and religious belief through an overview of his engagement with the idea of God throughout his career. Part 1, published in Sartre Studies International 19, no. 1, examined Sartre's early atheism, but noted the pervasive nature of secularised Christian metaphors and concepts in his religion of letters and also the centrality of mankind's desire to be God in L'Etre (...) et le néant ( Being and Nothingness ). Sartre's theoretical writings sought to refute the idea of God, but in doing so, made God paradoxically both absent and present. Part 2 considers Sartre's anti-theism and its implications for his involvement with the idea of God before examining in detail his final encounter with theism as outlined in L'Espoir maintenant , arguing that it is part of Sartre's long-term engagement with the divine, but refuting the idea that he became a theist at the end of his life.
